Did anyone notice that Compete America seem to have changed its website recently? I visited their website after sometime and it seems that they changed it recently.
It is good to see Bill Gates and Eric Schmidt bring the focus back on green card wait times -

As everybody knows by now, recently Arizona's Governor signed a law requiring local law enforcement officials to take into custody persons when they have a "reasonable suspicion" that they are present in the U.S. illegally. My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Hi,
I�m currently on H1B, I'm planning to go back to my country for an extended period.
Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

AC21 pioneers, any recommendations on picking lawyers around NYC? specifically those that are fairly responsive and charge a fair price on all the procedures / docs that come with maintaining AOS, including a possible AC21 notification letter, renewing EAD/APs....

On Nov 8th, Senator Lieberman and 18 of his Senate colleagues, wrote to Michael Chertoff (Homeland Security Secretary) to extend 12 months opt to 29 months exercising his authority.
On Nov 11th, NAFSA President Johnson also wrote to Secretary Chertoff to make this change, endorsing above request.

Here is a scenario:
Previous I 140 (EB2 PD Sept 2005) approved and is now current
Current I 485 filed based on another I 140 with PD in Dec 2006.
Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.
Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?
How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?
If retrogression occurs once again do u still need to wait to port and get Green Card

I had a robbery case in the U.S. in 1995 and was sentenced to 9 years with 85%. Later, I was picked up by immigration and deported for the case in question. While I was in immigration jail I fought my case and won it but immigration appealed it on the first court. I decided to return voluntarily to my country instead of fighting my case over. Now I want to return home in the U.S.. I want to know how do I go about reopening my case.

is it possible and advisable to convert H1 B to H4 and go on searching for job and if find a job then coming back to H1? Are there any risks in this process? if so can some one explain me in detail?
Yes you can switch from H-1b to H4 status. later on when the prospective employer finds a new job for you then that they can file a change of status application from H4 to H-1b under non cap case.

Yes you can file for 485 even if you have 140 pending.
Since all categories are current as of july 1st, can i file for 485/EAD/AP even if my 140 is still pending. thanks.

Hi there.....Even I want to find out if I-131 (AP) can be RENEWED without paying the fee when I-485 has been filed with the new fee structure. The USCIS site has not mentioned anything regarding the renewal fee for I-131 in this case (whereas it is clearly mentioned for the EAD). Is there anyone who can share his/her experience of AP renewal without paying the fee?
