Montana Democrat Jon Tester voted against the DREAM Act last Saturday. While he was not alone, he did manage to upset one person who actually mattered a lot to Tester's being elected - Markos Moulitsas at the Daily Kos, one of the web's most popular blogs. I'm surprised no organization is following up with USCIS about the prompt monthly updates on pending Volumes. So much for the push for openess during the 90 day initiative by the President !
Going by the charts and Dashboard one would come to think the September volumes has whittled down to Zero !! Hmmm..

Guys I will be going for my first H1 visa stamping in New Delhi. I am currently in the US. I transfered from F1 to H1. Have been looking into documents to take to the interview, and looking at so many 221(g) cases, have been confused by this term "unemployment wage report". I would really appreciate it very much if someone could please tell me what is "unemployment wage report" and how is different then "prevailing wage report"? Also, do I need to take both of them to the visa interview? Thanks!

Hi,
I believe someone already asked a similar question but I just want to describe my exact situation:
- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B
With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?
I'll greatly appreciate any comments.

Yes, you don't have to be in the US while the 485 is pending. You will need to be here for any appointments - fingerprinting, interview, etc. You also need to intend to be a permanent resident and work in the position listed on the I-140 (assuming this is an employment-based case). CIS might issue an RFE on the 485, asking for evidence of this, so you need to be able to provide it.

Can people post experiences on turnaround time for getting medical test documents back from the doctor? I have heard 2-3 days after initial appointment, but the doctor's offices I have called say 7-10 business days. Also, I have heard that some doctor's are faster than others. Is this true?

Dear All,
Today i read that their is a new law prohibiting the employers from filling multiple applications for the same employee.
I have applied with 2 companies,as an employee , i have two different employers, who will file application for me.
Is it against the current law or ?
Pls help me asap , so that i can stop atleast one of the employer , if needed to file the application.

I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. Myself and my wife got first EADs with expiration of Sept 17, 2008. We both applied for renewal on July 14th, 2008 with TSC and my wife got her EAD under a month. My wife is using it work, where as I am still on valid H1b. My application was pending still then, I have called USCIS and put an expedite request on Oct 17, 2008. On Dec 3rd, my case status online updated saying, case transfered to one of the local office. I got a paper notice after 2 days saying:
for faster processing we have transfered your case to the following location.
and nothing in the next line, blank.
Even though I assume this was to faster my process, just wanted to know whether any of you have faced this.
Appreciate your reply.

My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.
My questions are:
Will they re-consider my case if lawyer submits the correct EIN number?
How much time will it take to process, if the willing to re-consider the case?

If your EAD is based on your husband's I-485 app I don't see any reason as to why that should affect your gc process if you move jobs.

i got CPO emails for spouse and self today, I am PD April 06 EB2
I had filed my prior applicaiton in EB3 with 485, Later i joined new firmB around august 2007 timeframe. and they started off again using old PD and ported to EB2, which was granted,
my new company filed for my 485 again as they thought it was right around when i moved and could raise RFE
I got an email today my CPO ordered, using 485# of prior filing
what should i do, tell USCIS or talk to lawyers, i dont want this to cause a denial
( I never used EAD or so, always on H1)
