Dear Friends,
I am traveling to canada for a conference. My H1-B is stamped on my old passport valid till 2012. In January 2010 I obtained a new passport from the indian embassy chicago as my old passport was getting expired. I will be traveling with both the passports.
Is it mandatory to transfer the visa from old to new pasport ?

I need to respond to a RFE related to proving Programmer Analyst being a Speciaity occupation.
I researched and found a memo from Terrance Way, Director INS issued a memo on this on December 22, 2000 and is available on AILA Infonet
AILA InfoNet at Doc. No. 01040603
I couldnt locate this memo in USCIS policy guidance memoranda search.
Can some one with access to AILA Infonet, please send me this document

Dear All,
I just have one thing to say to you all. You did bring attention and top newspapers covered our plight. I am seeing newspaper articles from NYT, Business week, BBC and Washington post.
Remember everybody, It takes mighty work to shake this, and we did that mighty work and I think you shouldn't be overcritical and wait for the fruits of labor to bloom.
We will do it one day........ we shall overcome one day... :-)
Just keep this passion going, if steam fizzles out, everything will flatten out and we will have to be on this all over again, so never let that happen.

Since stay in India need to be very short and also my travel is very near, I need to know whether it is safe to travel on an approved I 797 from my current employer?
I already have a H1 B VISA stamped on my passport with previous employer's name that expires on 30 Nov 2009.
Also, I would like to know whether I should select yes/no to the following question?
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*
Is H1B Transfer = H1B Renewal?

You should get to talk to USCIS coz this is wrong for sure......USCIS should issue you a new EAD with no additional cost.........Even if you do not plan to use EAD card get the issue fixed.......

My Husband was a F1 international student and his F1 service had stopped by his school, but his Visa( China) was expires on July, 2009. Couple months ago, he and I gets married and he is ready for file the green card. But his grandfather is very sick now and he have to go back immedately; however, he didn't file anything at this time. If he having a emergry that need to go back on June , what he can do now? I filed I-485 in Jan 2007 under EB-1 in Nebraska Service Center. Got finger-print, EAD, AP in April. No other status update after that. Online case registration shows LUD for April.
- Online processing dates show "Dec 19, 2006" for EB-1 I-485. Any idea when I should expect any updates ? What will be the next steps involved ?
- Any way to find out whether my application is sent to name-check ?
- Anyone else in the same boat ? If you filed around Jan/Feb 2007, please do reply back to this thread, or my email vinay.shah73@gmail.com

i applied my wife's H4 visa renewal on Feb 2008 but received the USCIS Ack as April 2008. when i see the processing times now looks like the processing time for the I 539(H4 Renewal) is October 2007
Does any body have any understanding on the processing times on when my H4 Visa petition would be processed with USCIS ack date as april 2008 . any suggestions would be apreciated

My wife got her H1B approved couple of months back (Sep 2008). She did not get a job till now (Nov 2008) due to the market conditions. We need to travel to India early next year and have to do visa stamping.
1. Can she go back on her H4 and then go to India and get it stamped? She had been on H4 since Oct 2003 up until Oct 2008 (when her H1 became valid). If she goes back on H4, how long will it be for? Does her clock for 6 years of H4 start again after this change back from H1?
2. Once she comes back from India, can she look for a job and get back on the same H1? Will she be required to go through the cap? How much time will be remaining on her H1 (6yrs - 2 months that she worked)?
3. Please advise if there are some other options to keep the H1 (do not want to go thru the cap again) but not getting it stamped when in India. If we get paystubs from the employer for some months on H1, will that help?
