Hi,
Recently we moved. So I did not apply the AP renewal(a two month window) till we move. But now my wife has extreme family accident/emergency in India. So we applied for AP online and went to Chicago field office (we went there because kid also need INDIA VISA STAMP) and to Milwaukee office with letter from document. They said that they would not approve. So I have sent the support document s for I-131 to the Texas Service center in overnight courier service today. I have H1 valid till may 2010. What are my options?
Does her travelling on H1 with AP pending will cause problems to I-485?

it might be a little bit tricky to find this out. Talk to IO about your 485 and ask her about 140 during the conversation. She might tell you the PD on that. Once, I successfully reconformed my PD by trying this way ( I have approval notice with me though).

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.

Hello All,
I am an Indian citizen and a Permanent Resident of Canada. My Fiance is a US Citizen and we're planning to settle down soon. I also have a valid 10 year US B1/B2 Visa.
I know that if one marries a US Citizen you can get US Green Card but I am not sure about the processes. I want to know what is the best procedure so that I can be in the US quickly and also have my green card.
I know there is something known as Fiance visa but I'm not sure how it works.
Can anyone please elaborate and guide me into this situation.

Hi,
I got a RFE while doing my H1B transfer under premium processing. They have stated to respond within 60 days. Does anybody have an idea as to whether it takes so long or it gets resolved soon under premium processing? Please help.
Once they recieve the response, if they are satisfied, the same day they will approve. It will not take that long depending on the type of RFE.

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Given the uncertainity of getting green cards and the possibility of having to move back to India with your US born kids I would like to seek opinions on what IV members think is a relistic timeframe for kids born and raise in US to be able to tranfer to schools in India and still able to adjust/cope.
I am refering to regular SSC/ICSE/CBSE school in India (not IB or International schools). I am sure that the workload and requirements of the Indian schools is much rigorous then public school in US.
