Dear members,
I want to consult an employment/labor lawyer with regards to an employment agreement that I have signed with a desi consulting company in US. They have sponsored an H1b for me which I am yet to get stamped. I am in India right now and wanted to talk to a Labor lawyer who could tell me the effects of not joining this employer given that there are certain terms and conditions stated in the agreement. Could you suggest me some law firm in US where one can speak to a lawyer on the phone for a reasonable amount of money and seek legal advice.

Both my wife and I are working on H1B visa.
We are landing in Canada for H1B visa renewal.
However, the nvars.com appointment system allows 1 primary applicatnt and then allows to add dependents to that application. Should I add my wife as a dependent or create an independent primary applicant profile for her since she would be requesting an H1 B renewal as well.
If I create an independent primary applicant profile for her, I may not be able to get the same visa date / appointment for both of us.
Please guide.

This is such an open ended question. It will be very easy to answer if you can add few lines about your background, affordability and qualification(like GRE etc). If not the school names will be all over the place from MIT to the ABC University....as the word "Good School" is very subjective.

HI All,

1)what should be the time period between the Job switch from one employer to another after 6 months of filing of I-485.(AC-21)
2)Is it required to be employed until i get my actual GC ?
3) I am in the period of AC-21 (i.e 180 days completed after my I-485 filing)
If I marry to GC holder . Do i still have to maintain my independent status of I-485 or i can be given some status because of marrying to him..

Hi,
We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved? In case my I-140 is denied, will she lose her status and would have to leave the country?

1)I graduated in masters in december 2008.Iam working on OPT extension which expires on june2,2011.Iam thinking to apply for H1.Accordint to current situation,can i submit H1 application after october 2010 also? as CAP will be still open for masters quota(hoping)?can i put start date immediate after my opt status expiry date or it will start only on conventional date oct1st of every year?
2) Iam planning to fly India in between mar 2011 -may 2011 for 1month...so if iam approved with H1(if above questions says yes) then i need to go to H1 stamping and when i enter US ...i need to change my status from opt to H1 right at US entry.
3) if iam going in apr/may 2011 when should i start the H1 processing?(it should be before 6months only)

A hand written personal greeting card will be a good idea (no e-cards please)

Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

On Nov 8th, Senator Lieberman and 18 of his Senate colleagues, wrote to Michael Chertoff (Homeland Security Secretary) to extend 12 months opt to 29 months exercising his authority.
On Nov 11th, NAFSA President Johnson also wrote to Secretary Chertoff to make this change, endorsing above request.
But so for nothing further has come out.
