Hi All,

We are having same problem, received I-539 copy and it is showing class type H1b for my wife, and it is supposed to be H4.

Can anyone let me know what is the procedure for correcting class type??

I dont know if people would be interested in discussing the implications of all EB categories turning current. Some of the points to discuss would be:

1) Processing times for I-485
2) Effects on future GC applications.

etc

3) Whats if the CIR is passed in its current form ? How does that affect these categories is at all

Hi,

Once our 140 is approved in the sixth year of H1B, I learnt that we can seek a 3 yr extension. If that's the case, can we change companies during that 3 yr period or are we stuck with the same company that sponsored the 3 yr extension?

All,

I wonder if more of you have noticed this phenomena: one of your applications gets approved, but the approval doesn't show up on the online case status system.

My AP was approved on Sept 17, 2007 and mailed out to my attorney who got it in a few days and told me about yesterday when I emailed about another issue. Oddly enough, even today (Sept 27), the online case status system shows an LUD of Sept 14 but no approval. I didn't get the usual approval email from the case status system either.

Annoying -- since now I won't learn of new developments till my lawyer calls me up to let me know and you know what slackers they can be. Although all this may be moot since apparently I am stuck waiting for my name check to clear, so there won't be any new developments to look look forward to for a long long time. Sigh. :(

I can't see any good reason why they would do that unless they have a system to allocate the applications to adjudicating staff by State or by Region. Do the Chinese cite any reasons why they feel that way?

Many of us have had a positive reaction to the TB skin test. So we take an X-ray to confirm we are fine and the doctor mark normal in the chest X-ray section. Pretty routinely done.

Now my spouse had a negative TB skin test, so no X-ray needed. However the physician and my attorney have different views on how to fill out the chest X-ray section of the form. The physician checked nothing in the section and is very adamant about the way he fills out the form. My attorney believes that the NOT DONE box in the section should be checked as he claims that he has seen REFs if the NOT DONE box is not checked. What is your opinion? Appreciate your feedback. Thanks.

New employer agreed to give me similar job duties in EVL & I am getting 40% hike. Is it wise to use AC-21 here?.

Hello

We moved to a new location after filing our 485, EAD and AP petitions. We immediately sent the AR11 forms (by Fedex) and also did the AR 11 form online. Apart from this we updated the addresses for all pending petitions.

The status is as follows:

1. My wife's EAD went to the old address and fortunately USPS forwarded to our new address. However my EAD has not yet reached me though when I check online it looks like it was approved on 1st Oct. How do we track this?

2. I have received the address change confirmations from USCIS for my 485 petition. I have not received the same for my wife and daughter's petitions. Do I have to go and update the address change once again online?

Kindly advice based on your experience.

I believe they promise a 15-day (business days, I assume) turnaround on Premium Proc applications. So it could take anywhere between 1 and 15 days, if not longer in certain cases.

Also, why is going to India dependent on receiving on an approval of I-140??

Hi,
My wife's H4 was recently approved along with my H1. We both have different last names. My name is misspelled, an "a" missing and her middle initial is also different. What can I do to get a corrected H4? Can I go to local immigration office or something? My lawyer contacted the USCIS and they said they will respond in 45 days. They don't even guarantee that they will correct the approval document.
Please let me know

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

Hello all, my apologies if you find my question naiive. We got our fingerprinting appt. notice in the mail yesterday with an EAC application no. When I look that number online it says case has been transferred to Texas and notice of transfer sent. Fine. I am not anxious or anything just wondering if a receipt will be generated now at Texas or would one have been generated at Nebraska and sent to the lawyer? The reason I as is I have been holding back travel plans and wanted to start looking at flights etc. if I know the receipt is either on its way or at the lawyer's already.

BTW the application was sent to Nebraska on July 30 and I140 had already been approved from Nebraska earlier this year.
