Hello,
I am on H1 B and wife is on H4. H1B is expiring in Nov 2009 and my employer is going to file for extn. My wife is currently doing her Masters on H4. Need some advise to here
1) If I apply for extn (H1 & H4) within next 2 weeks it will take atleast another 3 months before I will come to know the decision. Nowadays lot of H1B extensions are getting rejected. Will it be a good idea to move my wife's status to F1 and not apply for her H4 extn..?
or
2) Should I wait for my decision on extension and if it gets rejected then apply for F1
or
3) Apply both i.e. apply for extension and simultaneously for H4 to F1. Any issues with this approach?
I don't have constraints on paying fees on H4 or F1. All I want is my wife should be able to continue her studies. I am working in an Indian company, so even if my extn gets rejected, I will go back to and continue work, but still want my wife to continue studies.

I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?

Hi,
My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.
Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

I just missed 120-90 day window for filing EAD. My EAD expires on oct 12 and today is July 12TH.
Other stats:

I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can we get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean converting from H1 to B1 for multi year?

No, the H1 6 yrs period will apply only when for the period when your Payrolls where generated using H1 visa.

IV website service provider has informed that they will be installing new hardware on the core switches that are used by IV servers. As such there is a scheduled down time of up to an hour which will occur on October 24, 2008, sometime between 12 AM CST and 6 AM CST.

As long as you have a valid advance parole, an approved I-140 and a bona fide offer of employment in the same or similar occupation you are not likely to be at risk if you go to India. However, before making a decision to travel, you should consult with an immigration attorney fully familiar with your immigration and employment history.

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.

6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?

My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

My congressman's office came back with this response for my query on why my wife's case is pending..not even pre-adjudicated, while I got approved on Sept 3rd from TSC.
according to TSC, your file and your wife�s were separated at time of adjudication and that is what has caused the delay. I�m trying to find out why.
Anything like this happened to anyone. Is there anything that can be done, to recombine the cases. My attorney is not very responsive since he was with my last employer. What are my options? I am worried her case is falling thru the cracks. Without any information on the principal applicant and derivative's case may never get adjudicated.....

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.
