Here is a question for one of my friend
He is a July 07 filer and has I 485 pending for more than 180 days, has EAD and AP.
All through the years he has been on H1. however there is a gap of 40 days between change of employer on H1. (The H1 is approved after this gap of 40days) Is he in the status during this gap of 40 days because he has pending 485 and has valid EAD/AP?

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
Do we have to immediately withdraw the petition after losing/quiting a job?

Hi,
I need some clarification. One of my friend confued me.:confused:
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.

Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

We have filed an I-130 for our dependant child of my husband who is currently an alien resident. We are trying to figure out how to get a work authorization form started for our son as well as he is old enough to work. We can not figure out how to answer his eligibility catagory. I changed my employer after 9 months of filing 485 using AC21 a year ago and my new employer has reduced my workdays to 3 days a week starting this month. Can I get a second job for 2 days a week with same job description and salary etc ?
