Dear members,
I am working in India. I have an L1 petition which is valid from sep 2004 through sep 2007 from my company. When I went for visa stamping in 2004 the visa officer gave me a visa valid from sep 2004 through Nov 2005. This meant that I could enter US only in the first year of my petition but continue to stay legally in US on an I-94 through Sep 2007. As of today, I may have to leave for US in March 2007 on this L1 and my question is that if I go for a renewal at the US consulate will they renew my visa for a petition that will expire in Sep 2007. Considering that there are only 7 valid months left on the petition.

Hi,
I wanted to know that suppose i withdraw my H1 ,
then does it means that my H1 is gone?
And if i want to have H1 again if future (say next year) , will i have to go through the lottery again?

I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.
Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.
I am planning a vacation to India in November 2010, what are the options with me when come back to US.
- Do i have to stamp the H1B visa OR
- I can still come back on my existing L1B visa ???

C-SPAN, the exclusive video chronicler of Congress, yesterday took a major step to loosen its copyright hold by announcing that it would no longer object to YouTube or bloggers posting its footage from the Hill or from federal agencies online. The content makes up about half the cable channel's programming.
Use of the video footage became awkward recently when Republicans accused Pelosi of "pirating" some clips for her new blog, the Gavel. C-SPAN explained that floor footage is shot by government cameras and that Pelosi was on firm ground using it. But C-SPAN did ask her to take down a clip of a committee hearing shot by a C-SPAN camera.
A C-SPAN spokeswoman said yesterday's action was a nod to the ever-changing technological landscape.

Hi All,
My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.
My questions are:
Will they re-consider my case if lawyer submits the correct EIN number?
How much time will it take to process, if the willing to re-consider the case?

Hi,
My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?

I want to change my employer from A to B. B has filled for h1b transfer on 26-sept-2007 (I have fedex tracking number). Till today (9-oct-2007) we hv not received the receipt notice.
My expected start date was 1-oct which has been extended twice, i.e 8th & then 15th. If receipt does not come will 15th, then can I join the new employer?
Is there any way I can find out the file position/status using fedex tracking number?
Can new employer file one more application for h1 transfer under premium process?

My wife paper-filed her EAD and didn't have to do Biometrics.
Will she have to do her Biometrics when she paper-files or e-files her AP?

hi gurus, a question.
I am currently out of US but working for same company in Europe
I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).
I am now a sr manager and seem to be eligible for EB1C (if company agrees).
Option 1)
- continue to stay in Europe and apply for 140 (eb1c)+CP
- while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)
Option 2)
-move to US on L1 visa and apply for 140 (eb1c) + 485
Option 3)
- wait for PD for eb3 application to be current
Hope the above makes sense.
Can you pls suggest the best option & approx 'how much time' it will take for option 1 & 2. (understand option 3 is unpredictable).

Hello,
We have our 485 interview's next week @ the Baltimore Field Office. My PD is current for EB-2. My case is pretty straightforward so hopefully should not be a issue.
Would appreciate any comments from folks in MD who have been interviewed @ the Fallon Federal Building in downtown.
Particularly - can they approve our cases right there & then.? Will they stamp our passports for approval since PD is current for January 2011.? Can there be any issued with visa number not available, etc. ?
Any advice is appreciated.

Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise.
