I just realized a stupid mistake was made after filing my COS from F1 to H1B. My employer sent the entire application this Monday to Vermont Premium Processing Center. I had no idea that the I-539 was not even needed and that I-129 and I-907 were sufficient enough to proceed with the COS. Anyway, is there a way to correct this error? I'm just hoping USCIS won't reject my application and just process my COS.
I included a separate check worth $300 to pay for the I-539 but the rest of the payments were issued by my sponsoring employer. I really thought I-539 was one of the requirements so I went ahead and included it.
Any input will be appreciated.

If you resigned, then I dont think company is liable for any severance. I work for a bank and they have a policy that they consider attrition due to visa issues (like unable to extend H1 etc) as termination for employment. They pay severance only for displacements which happens due to lay offs. I may be wrong and policy might be different in your company but just my 2 cents.

Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Hi,
I applied SSN 3 week back and planning to go to India for 2 months due to personnel reasons. I am not yet received my SSN.
Is there any problem, If I go to India before getting SSN ?

the format of employment date should be "mm/dd/yyyy", or just 'mm/yyyy'?
my last day in my previous employer was a Friday 5/15/2009 and my attorney entered 5/17/2009 (Sunday) as my last day on the LCA coz my first day in my current employer was 5/18/2009.
I am asking my former co-workers to write experience letter for me. Should I let them write '5/15/2009', or '5/17/2009' or just '5/2009' on the letters?

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.
The only reason iam planning to file h1b in 2-3 months from now is i dont have last 2months of paystubs as i was on vacation and other reason is my current project may be done in may or june.
So please advise me what is the best way to deal with the situation.

I have changed from h1 to f1 in 2002, but did not apply through the mail in status change process, just took my I20 and got it stamped in a Consulate outside US (Mexico in my case).
So not sure, how the mail in status change would affect you if you directly show up in a US Consulate. It is probably best to ask a Lawyer.

I heard now they are issuing passports in less than a week.
If he has a GC he can still visit on his old country passport without any issues.

I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

My EAD got approved today. It is in card production stage.
