Hi Readers,
My fiance has a (U.S) MS degree in Chemistry but has been working on H1b as a computer programmer for the last 2 years ? All her undergraduate work has also been in the Sciences. Her GC sponsor is a software company and she will be applying as a computer programmer. Does anyone have experience with this kind of Labor Certification situation ? Thank you for any help.

I know many friends of mine, who has done B.E and MS from diferent background (like Mechanical, Electronics etc) and were still able to get the LC approved from a software company since they were working there. There should not be any issue with it.

My wife who is a derivative applicant for the GC is employed on EAD. She has been advised to go on a pregnancy short term disability leave by the doctor. We live in California and her company provides the short term disability through the California SDI.
Is it ok to claim this while having applied for GC. Is the SDI by any chance considered a public charge? Any help would be appreciated.

I am having a problem and dont know where to start on this one, my experience in c# programming is average and was hoping for some advice on this subject. I have a disc image (an exact duplicate of a 40gb hard disc drive) the format is a dd image.
My task requires me to programmatically read through the files on this image, compare file extensions and recognise certain file types on the drive. Is this possible? I cannot find anyone who has attempted this on the internet and would appreciate any guidance to get the ball rolling.

Yes. The petition will be like a regular change of employer H-1B petition. The lawyers will tell you what documents they need from you when filing the company's H-1B petition.

I guess that is also H1B as H1B for non-profit organizations does not fall under yearly quota .they can get H1B anytime , so no need to wait til Oct.

I understand that the July VB is reinstated until Aug 17 for new applications for AOS. What happens to AOS applicants of the past? Does this means that the visa numbers are available for restarting processing of those old applications?
Or this reinstatement is restricted only for filing new applications (to abide by INA)? If latter is the case, and earlier option is not viable due to unavailability of visa numbers, then the "current" status (until Aug 17) is not really current, isn't it? Am I understanding this situation correctly?

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted. 1. My 140 is filed and pending. I did not go through premium
2. How to get the CP appointment?
3. Since we dont file 485 if we prefer CP, what happens if the visa dates retrogress,but you have a CP appointment?
4. Is there a way to secure something in CP while the dates are current. ie, in AOS, just filing is enough to avoid several hassles. Is there anything like this in CP.

The ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.
Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

hello! i overstayed my visa by several years, left , and was able to get a new tourist visa and enter the u.s.
after leaving the u.s, on return,i was denied enterance, removed and banned for 5 years. my boyfriend lives in u.s, he's a citizen. is a fiance visa helpful to allow me in until we get married? is there even a chance? or do we need to marry outside of the u.s in this case? thank you!

The inventory number does not include the EB1 and EB2ROW filings, which are always C and out of queue/approved in less than 6 months. They are not shown in inventory numbers.

When you have no GC and are on h1 legally...can you go on a cruise..I do not have stamping on the PP ..the cruise goes to some places in the caribean??..is there a immigration check while comming back??..how does this stuff work...OR is it no GC no Cruise??..
