I am currently working for Company A on h1b, expiring on May 31st 2010. The GC application is denied based on on A2p issue with company A.
I had company B already filed for my labor in 2008 and approved in Jan 2009. They also filed concurrent 140 and 485 in March 2009 which is still pending. Company B wanted to hire me and now its time that I move to company B. I do have latest paystubs from Company A, currently valid i797 and experience letter.
can I migrate to company B by transfering my h1b based on approved labor with company b and pending GC application. What documents are required to transfer.

i got CPO emails for spouse and self today, I am PD April 06 EB2
I had filed my prior applicaiton in EB3 with 485, Later i joined new firmB around august 2007 timeframe. and they started off again using old PD and ported to EB2, which was granted,
my new company filed for my 485 again as they thought it was right around when i moved and could raise RFE
I got an email today my CPO ordered, using 485# of prior filing
what should i do, tell USCIS or talk to lawyers, i dont want this to cause a denial
( I never used EAD or so, always on H1)

My employer has filed my labor certifications few weeks back. Is there a way I can track it online and know the status.
What information do I need to do that ? Whats the website ?

By law they are supposed to approve EAD in 90 days.
There is no such restriction on AP. So USCIS takes its own time.

Hi every1,
I am on H1. I got married earlier this year :), my wife is on OPT which expires early next year. She is currently working for XYZ company which would not extend her OPT. We haven't been able to find a job(H1) for her yet.
Would any of below can cause any problem.
1. I don't have H1 stamping from my home country??
2. Her last name is not changed??

Gurus..I need some help
My I-140 is approved. I recently got 3 year extension and I am in my 7th year currently.
I may get a better offer. My question is
1. Since I have a new H1b which is valid for 3 years (for H1b year 7,8 and 9), can I transfer it to a new employer?
2. Also, the new employer is willing to file GC, can I use my old PD date. (the new job profile is similar)
3. If the current employer withdraws my I-140, will that affect my H1 transfer?
Please help.

Hello,
Got H1B this year via consultant,valid from Oct 1st to 2010. Applied for AOS(dervative) and got EAD, AP and I-485 receipt notice by Oct end. So I think my status is AOS now.
I haven't been put on project yet.
Planning to travel next month using AP.
On return I plan to find another job using EAD.
I wanted to know if and how using AP to re-enter effects H1B status.
Also will this "bench" period effect GC processing in anyway?

Hi,
I filed for extension of H1B through my company A. I got notified today that my H1B filed was sponsored by sister company B. My GC was filed by Company A in July 2007 with PD of EB3 2004 December.
Would my GC process be impacted by this mess? Since GC process was started by company A, which would now be ex-company due to company B being new H1B sponsor. I am still on H1B.
Does it make sense to invoke AC21.
Please suggest.

Really disappointing. Senator Schumer says on the one hand that the targeted companies are not violating the law and on the other says they are underpaying their workers - which would be a violation of the law. Which is it? And he disparages the entire staffing industry - an industry that in the US employs far more American citizens than immigrants - by questioning the legitimacy of the business model and complaining that these companies don't make anything. I have been cheated by a desi consulting company e-Data experts located in Harrisburg, PA. They applied for my labor in December of 2007 and it was audited and finally I was told in June 2010 that it was denied. Actually it was denied in January 2010 but they did not reveal this information intentionally. Now I am in my 6th year of my H1b which expires in March 2011. Can someone help me out how to sue the company for not revealing the information and firstly how can I stay in the country. BTW I have done Masters here and I am with another company now. Appreciate all your suggestions.
