Hello:
I'm Canadian who've worked in US for the same employer under L1 Blanket for almost 3 years, my current L1B will expire at July 2011. I heard a lot of L1 extension get rejected recently, I wonder if I can have a fresh L1B petition (I-129) with another 2 year, then go to US-Canada border and turn around with the fresh L1B petition, so I can stay in US for anther 2 years.
My only concern is that, do I qualify the '1 year working at foreign branch within 3 years prior to admission to US' requirement? considering I've been in US almost 3 years already.

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.
DO anyone has info on this

It is a travesty that the fates of some 35 million Americans who need food aid are tied to the farm bill, which comes up every five years. The House passed an inadequate version last summer, and the Senate has failed to advance its own. It is time to ask why feeding the hungry must include a trough for multibillion-dollar agribusiness.
As it has pressed to keep its subsidies, about $26 billion in the current bill, agribusiness has contributed $415 million to federal political campaigns since 1990, according to the Center for Responsive Politics. The hungry don’t have much of a lobby. But those who cannot consistently put food on the table need the help promised in the bill, including more than $4 billion in improvements in the food stamp program and for emergency assistance. If the aid remains in the farm bill, and if it remains in a logjam, aid would continue at current, inadequate levels.
Food stamps regularly help 26 million people get something to eat. But the previous farm bill did not peg benefits to inflation, so as food prices have skyrocketed, families who were just barely getting by are now in a much worse place. Some 800,000 food stamp recipients — disproportionately elderly or disabled — are being told to make due on a minimum benefit of $10 per month. That amount has remained unchanged in 30 years.
As The Times recently reported, food banks and soup kitchens across the nation are being depleted by demand so overwhelming that the needy are being turned away, or given help so minimal, it is hardly worth the energy expended to get it.
Washington needs to do better. The Senate could start by rallying around the sensible legislation sponsored by Senators Frank Lautenberg, Democrat of New Jersey, and Richard Lugar, Republican of Indiana. It would replace crop supports with an insurance program to cover actual losses, and put the savings, potentially billions of dollars, to better use, including for food aid.
Or the Congress could make a bold statement and begin to restructure funding. It could get money to food banks faster if it came out of any bill but the farm bill.
The Bush administration has correctly opposed the excesses of the farm subsidies program, but it could do more. It could finance additional and immediate food assistance by dipping deeper into money culled from customs receipts to support farm and nutrition programs.
Since their beginnings, hunger relief and nutrition programs have been inextricably tied to helping farmers. That may have made sense once. But as recent maneuvers on the farm bill have shown, it no longer works.
Republicans — by far the biggest beneficiaries of agribusiness largess — are using the advantage of being a bare minority to try to attach a flurry of amendments on immigration, taxes and any other issue but the desperate one at hand. Farm state senators look the other way so a bill, warts and all, can get done.

Even when officers work on your files, there may not be any LUDs.
If you input all your case numbers (old H1B approvals etc), you will see that those get LUDs once in a while. They may be batch jobs or someone pulling files frequently or filing old applications etc.
Since your PD is a few months away, it is best to just relax and hope your applications are preadjudicated. When your PD becomes current, then go the Service Request - infopass - senator/ombudsman route.
If you are that interested, take infopass appointments and find out where your application is. If the CIS person is friendly, they give out a lot of information. Dress well and talk politely.

Hi,
I have changed to a new employer using AC-21 recently. I have pro-actively sent AC-21 documentation (new offer of employment, covering letter and supporting docs) to USCIS. Ever since, I am checking my case online. Its about 3 months now that I have sent this info and there has not been any update/LUD on my 485 case so far. I am not sure if my I-485 case has details about my new employment.
I am currently doing my EAD renewal. I am thinking if it will be possible to indicate to USCIS about my new employment. Can you please advice on -
a) if it is wise to do so?
b) How can it be done?

My daughter is on F1 visa since she turned 22 years. She has her AOS (employment based dependent on me) pending. I-140 cleared and I -485 filed before she turned 22 years. She has also received her EAD and AP based on pending AOS.
We are planning to go to Canada and she want to use AP for reentering USA. My question is:
1) Once she enter USA using AP what happens to her F-1 status? Can she continue her F-1 status?
Appreciate guidance from Gurus/ Lawyers.

I am an EB3 (rest of the world) -
My I485 has a receipt date of 7/24/2007.
The processing date TSC is showing is 7/16/2007.
When my date comes up inside the Processing dates range, will the category be relevant for the approval? I am asking this question because I have a friend that is an EB2 and a receipt date of Sept 2007, and got his GC on December 2007...
If the categories are relevant, how can we monitor the process (the processing dates then become irrelevant)...

Please be aware that W2s at 140 stage are mainly asked to judge the "ability to pay" of the employer. There can be other reasons too.

I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

As I understand , either there would be no bulletin revision(currently appearing impossible) or there would be a bulletin revision making some categories unavailable , in which case it doesnt matter even if your application has made it on July 2nd it will be returned. So why is the rush to get applications by mail/fedex/samedaydelivery/inpersondelivery/etc ?
Or is the rush to deliver only for those applicants with PDs in 2002-2004 who are hoping that their PD will make it in the new bulletin if it is not unavailable? I see no reason for the rush which seems to have increased after the rumor about the new bulletin on friday ...(although I personally asked my lawyer to send it on friday 6/29 and for which I have no confirmation if it was actually sent or not).

My company filed a new PERM application recently. I have a EB3 I-140 approved from my old employer ( Approved in August 2009). My attorney had filed the new PERM and requested to capture the same date. Will this cause any problems? Below is the question that is asked in ETA9089 form.
1. Are you seeking to utilize the filing date from a previously submitted application for Alien Employment Certification (ETA 750) ?
Did anybody had come across this issue. Your feedback is appreciated.

Giving I-485 benefits to people without current PDs is a bad idea.
so what 's good idea to you......putting all of EB applicants who are waiting to file 485 in waiting state until you get your GC is a good idea?
First of all, why are you being worried about this action item being EB1 applicant and you will get your GC in no time...
I don't think you are from EB1 category...You are selfish mind who holds EAD and doesn't want other EB applicants to come in to 485 waiting line.
would you have had the same thought if there was no July 07 fiasco and if you would need to wait in the line........selfish minds like you can't stop this action item.
