I just realized a stupid mistake was made after filing my COS from F1 to H1B. My employer sent the entire application this Monday to Vermont Premium Processing Center. I had no idea that the I-539 was not even needed and that I-129 and I-907 were sufficient enough to proceed with the COS. Anyway, is there a way to correct this error? I'm just hoping USCIS won't reject my application and just process my COS.
I included a separate check worth $300 to pay for the I-539 but the rest of the payments were issued by my sponsoring employer. I really thought I-539 was one of the requirements so I went ahead and included it.
Any input will be appreciated.

Hello Guys
I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

I am traveling to India after long time. The airline reservation requires me to provide my green card number. Can anyone tell me what that is? Is it A# number?
I tried entering the 9 digits of A# number on the airline website without a success, what is a right syntax?
AXXX-XXX-XXX or XXXXXXXXX without using �-�
I don�t want to submit wrong information.
Also, is it possible to provide this information at Check-In and not to worry about it now?

Bush is visiting Csico, San Jose. There is a huge EB community in Cisco afftected by retro. I talked to my friend there and he said guys were planning to ask one question about this to Bush. Apparently ther was lot of activity around this . Any update guys ? Any one from Cisco pls respond

I'm currently getting everything ready to mail my forms to get a green card through marriage. I've heard that I would have to send an employment verification letter from his boss. But some people say it's optional, I only send it if I want to because he's already got his taxes done proving he can afford to support me.
If I do have to send the letter, do I need anything else along with it as proof? Either to mail them alongside the letter or for the interview?
Any help will be much appreciated. I've heard conflicting stories and don't know what to think.

In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesn�t explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Right now, employers have to go to all the trouble of preparing a case that may be rejected simply because the visa allocation is filled. I think...

Hello,
1. I last entered US in Dec 2009 on H1B valid till Sep 2012.
2. Was laid off, changed my status to F1.
3. Got new employer, transferred my H1B to the new employer, got approval notice with no I 94 attached. My H1B visa stamping is valid till Sep 2012.
What are my options? Do I need new H1B visa stamping? Or just re enter with new I94?

Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?

Hello everyone,
My questions are about F1 to H1b change status.
I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:
1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?
2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?
3. In my situation, what should I do right now? Do I need to find a school to keep my F1 visa? When is the best time to find a school?
4. Can I transfer H1b to another company during my H1b is pending?
I am very appreciate if you can answer these questions. :)

I will change my employer in April and transfer my H1 with my wife's H4. My wife has found some company which would sponsor her H1B. I am on EB2+485 pending. My wife is on H4(we haven't filed her 485 due to retrogression). I am very confused now. Please help me!
1. My wife's company would apply H1B on April the 1st. My new employer will transfer our H1&H4 after that. Will we have any problem here?
2. My new employer would sponsor me EB1. I have EB2+485 pending. If I apply for EB1 140+485, what will happen my old 485?
3. I am thinking to apply 140 first and if 140 gets approved, I will file 485. I am not sure if I have any risk here. Is there any chance that my EB1 485 gets denied? Do my EB2 485 and EB1 485 have the same chances to get denied?

the receipts etc will be sent to the address you provided in the applications and are not forwarded, to new address. stay where you are till you get the receipts.

I heard you can file Perm only if you are on H1 or other status and not on EAD (AOS Pending I485).
That is not true....
You certainly can file new PERM while on EAD. So go ahead and do EB3-EB2 porting...
